Indiana Disclosures: Seller's Residential Disclosure and Material Defects

Indiana · State License Law — free study notes for the real estate licensing exam.

🏛️ State License Law 📍 Indiana

📖 What you need to know

Indiana law requires sellers of most one-to-four-unit residential properties to complete and deliver a Seller's Residential Real Estate Disclosure form to the buyer before an offer is accepted, disclosing known defects in the property's systems and structure. Licensees must disclose known material defects and their agency status, and may not actively conceal or misrepresent conditions of the property. Indiana is not a community property state, so marital-property ownership is determined by title and standard real-property rules rather than community property law.
