Ohio's Agency and Representation Model

Ohio · State License Law — free study notes for the real estate licensing exam.

🏛️ State License Law 📍 Ohio

📖 What you need to know

Ohio law recognizes that a licensee may represent the seller, the buyer, both parties, or neither, and the representation relationship must be made clear to consumers. At the earliest practical point in a transaction, the licensee must provide the Ohio Agency Disclosure Statement so each party understands who represents whom. Dual agency, where the brokerage represents both buyer and seller in the same transaction, is permitted only with the informed written consent of both parties. The brokerage's overall agency policy must also be disclosed so consumers know how the firm handles representation.
