Test yourself first: 5 questions
Question 1 of 5
Which Florida agency is responsible for investigating complaints and imposing discipline against real estate licensees?
Answer: B. The Florida Real Estate Commission (FREC) operates under the Department of Business and Professional Regulation (DBPR) and is the body that adopts rules, investigates complaints, and disciplines licensees for license-law violations.
Question 2 of 5
Which of the following best describes 'concealment' as a prohibited act under Florida license law?
Answer: B. Concealment is the failure to disclose a material fact when a duty to disclose exists. Along with fraud, misrepresentation, and dishonest dealing, it is grounds for discipline under Florida license law.
Question 3 of 5
Which of the following acts by a Florida licensee would most likely be classified as a first-degree misdemeanor 'unlicensed activity' problem rather than ordinary license discipline?
Answer: C. Performing real estate services for compensation without a valid, active license, including continuing to operate after expiration or revocation, is unlicensed activity, which Florida treats as a criminal offense rather than mere licensee discipline.
Question 4 of 5
FREC operates under which state department?
Answer: A. FREC is housed within Florida's DBPR, which administers professional licensing and discipline.
Question 5 of 5
After a recommended order is issued in a disciplinary matter, which body issues the final order imposing or rejecting discipline?
Answer: D. The administrative law judge issues a recommended order; FREC reviews it and issues the final order, which may adopt, reject, or modify the recommended penalty within statutory limits.

What you need to know
When a licensee violates the law, FREC may impose discipline ranging from a citation or administrative fine to reprimand, probation, suspension, or revocation of the license. To protect consumers, Florida maintains the Real Estate Recovery Fund, which can reimburse a person who obtains an unsatisfied civil judgment against a licensee for acts arising from a real estate transaction. Once the fund pays on a claim, the responsible licensee's license is automatically suspended until the amount paid plus interest is repaid.
